- Introduction
These Terms & Conditions (“Terms”) outline the basis on which JCL Removals provides transport, removal, and logistics services.
By booking or paying for any service, you agree to these Terms.
Full and final Terms & Conditions are attached to your individual Summary of Service, which forms part of the legally binding contract between you and JCL Transport Group Ltd.
- Customer Responsibilities
By booking with JCL Removals, the customer agrees to:
- Provide accurate information on the nature, volume, and value of goods.
- Obtain all necessary documents, permits, or customs paperwork for the move.
- Be present or represented at collection and delivery.
- Ensure correct signatures on all delivery or collection documents.
- Prepare appliances and electronics for safe transport and defrost refrigerators or freezers in advance.
- Protect goods left in unattended or shared premises.
- Ensure access and parking availability at both collection and delivery points.
- Our Responsibilities
We will handle your goods with care and professionalism.
- We are responsible for goods while under our care and control, provided the customer has complied with all agreed terms.
- Where JCL performs packing, we may request photographic evidence of goods prior to packing for insurance purposes.
- We are not responsible for damage caused by poor customer packing, overloading, or incorrect information.
- Collection and Delivery
- The customer must arrange suitable parking and permits for our vehicle at both addresses.
- Any parking fees or fines incurred during loading/unloading are the customer’s responsibility.
- JCL is not liable for delays caused by traffic, weather, ferry cancellations, customs inspections, or other events beyond our control.
- JCL may use trusted subcontractors under our full supervision and insurance coverage.
- Loading and Weight Limits
- Our vans are not equipped with weighing systems.
- If a vehicle is found overweight, the customer must either remove items or pay for an additional van.
- If the vehicle is detained or fined for being overweight, all penalties are the customer’s responsibility.
- Additional vans may be arranged within 72 hours if required.
- Goods in Transit
- Customers must ensure goods are properly packed and ready for loading.
- Unless otherwise agreed, customers assist the driver with loading/unloading to ground or first-floor level.
- Drivers do not dismantle or reassemble furniture unless explicitly agreed.
- No liability is accepted for items not ready for collection or improperly packed.
- Packing Services
- Packing services include materials and labour based on the agreed vehicle size and scope.
- Extra volume or items beyond the agreed size may incur additional charges.
- For insurance purposes, photos or videos of valuable items (£100 or more) before packing are required.
- Goods Packed by the Owner
- Items packed by the customer are covered for total loss only (fire, theft, collision, or overturning).
- Damage to owner-packed items is not covered.
- Liability for such items is limited to £40 per item or £50 per box.
- No cover applies to dismantling, reassembly, or installation.
- Manpower Services
- All manpower bookings are subject to confirmation.
- JCL may adjust or reschedule manpower due to operational or external factors.
- JCL is not liable for indirect costs resulting from such changes.
- Customs and Transport Documentation
- JCL will handle customs documentation as required.
- All customs duties, taxes, or fees are payable immediately by the customer.
- Customers must attend customs offices if requested by authorities.
- A TOR1 form is required for UK imports; delays or penalties for missing forms are chargeable (£180 per day delay).
- Required customs documents must be provided at least one week before collection.
- Payments and Cancellations
- Full payment must be made by bank transfer at least 7 days prior to collection unless agreed otherwise.
- Cancellations made:
- More than 7 days before collection → Full refund.
- 7 days or less before → £250 cancellation fee.
- Less than 24 hours before → 50% charge applies.
- Service quotes are valid for 6 months and can be extended upon request.
- Insurance
JCL Transport Group Ltd is fully insured, including:
- Goods in Transit Insurance
- Public Liability Insurance
- Storage Insurance (where applicable)
- Delays in Transit
We are not responsible for delays beyond our control.
If delivery cannot be completed, goods will be placed into secure storage at the customer’s expense.
Once in storage, the service is deemed fulfilled.
- Right to Hold Goods (Lien)
JCL reserves the right to retain or dispose of goods until all outstanding payments are cleared.
Storage fees will apply while goods are held under lien.
- Disputes and Legal Jurisdiction
- Unresolved disputes may be referred to independent arbitration (Chartered Institute of Arbitrators).
- Legal proceedings must be filed in the courts of Folkestone, United Kingdom.
- English law applies to all contracts.
- Subcontracting and Route Selection
We may subcontract work where needed, maintaining full responsibility.
Routes and transport methods are determined by JCL to ensure safety and efficiency.
- Liability for Loss or Damage
Unless otherwise agreed:
- Liability is limited to £40 per item based on age and condition.
- No liability applies to:
- Acts of war, terrorism, or natural disasters
- Mould, damp, or wear and tear
- Electrical/mechanical issues without visible damage
- Customer-packed fragile goods
- Fire or explosion unless caused by our negligence
- Jewellery, money, securities, animals, plants, perishables
For vehicles: no liability for minor scratches or dents unless supported by a pre-collection report.
- Fraud and Claims
- Customers must inspect all goods immediately upon delivery and record any damage on the driver’s CMR form.
- Claims made after the driver’s departure or without documentation cannot be accepted.
- JCL is not liable where fraud or false information has occurred.
